Terms of Service

JDM Registry offers different account types, including trial accounts and paid subscriptions. Sellers must maintain an active subscription to publish listings. Account features and limitations are determined by your subscription tier.

• Trial accounts may have limited features and listing capabilities
• Active subscriptions are required to publish and maintain active listings
• Subscription fees are non-refundable except as required by law
• You are responsible for maintaining the security of your account credentials

You are responsible for all activities that occur under your account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security and confidentiality of your password
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities conducted through your account

Sellers must provide accurate and honest information about listed vehicles. This includes:

• Accurate vehicle description, specifications, and condition
• Complete disclosure of any known defects, damage, or issues
• Truthful representation of vehicle history and documentation
• Clear, recent photographs that accurately represent the vehicle
• Honest disclosure of any modifications or aftermarket parts

Sellers may be required to upload documentation to support their listings, including but not limited to vehicle registration, emission test certificates, or ownership documents. You agree to:

• Upload only genuine, unaltered documents
• Ensure uploaded documents are legible and complete
• Watermark sensitive documents to protect your personal information
• Understand that document verification does not guarantee authenticity
• Not upload documents belonging to others without authorization

Sellers may not:

• List stolen or illegally obtained vehicles
• Misrepresent vehicle condition, history, or ownership
• Include contact information in listing descriptions to circumvent platform fees
• Create duplicate listings for the same vehicle
• List vehicles they do not have authority to sell

By uploading content to JDM Registry (including listing descriptions, photos, and documents), you grant us a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute such content solely for the purpose of operating and promoting the platform.

You retain all ownership rights to your content and may request its removal at any time by deleting your listing or account, subject to our data retention policies.

"JDM Registry" and related marks are trademarks owned by us. Honda and other vehicle manufacturer names and logos are trademarks of their respective owners and are used for descriptive purposes only. Unauthorized use of any trademarks is strictly prohibited.

JDM Registry Philippines does not own, operate, or control any third-party document storage or sharing services. When you upload documents to such services and share links with us:

• You willfully and independently select the third-party service of your choice
• Your documents are stored on servers operated by that third-party service, not by JDM Registry
• All data transmission, storage, and sharing are governed by the terms and privacy policies of your selected service
• JDM Registry only receives access to view documents you explicitly share with us via mechanics@jdmregistry.online

If you are submitting documents that contain protected health information (PHI) or any healthcare-related data (such as drug test results, medical certificates, or clearances):

• You are solely responsible for ensuring that your chosen third-party document service complies with the Health Insurance Portability and Accountability Act (HIPAA) and/or any applicable Philippine data privacy regulations (including the Data Privacy Act of 2012)
• JDM Registry Philippines does not guarantee, represent, or warrant that any third-party cloud service is HIPAA-compliant or meets healthcare data protection standards
• Before uploading health-related documents, you must independently verify that your chosen service offers appropriate security measures, encryption, and compliance certifications

Applicable Documents: Drug test certificates, medical clearances, fitness-for-work certificates, and any other health-related documentation.

If you are submitting documents that contain Personally Identifiable Information (PII), such as police clearance certificates, government-issued IDs, or other identity documents:

• You acknowledge that police clearances and similar documents contain sensitive PII including your full legal name, date of birth, address, photograph, fingerprint records, and criminal background information
• You are solely responsible for ensuring that your chosen third-party document service provides adequate privacy protections and complies with the Philippine Data Privacy Act of 2012 (Republic Act No. 10173)
• JDM Registry Philippines does not guarantee the security or privacy practices of any third-party cloud service you choose to use
• You understand that sharing PII through inadequately secured services may expose you to risks including identity theft, fraud, or unauthorized disclosure
• You consent to JDM Registry viewing and verifying the PII contained in documents you share with us for the purpose of mechanic verification and platform trust & safety

Applicable Documents: Police clearance certificates (PCC/NBI), barangay clearances, government-issued IDs, TIN documents, and any other identity verification documents.

BY USING THIRD-PARTY DOCUMENT SHARING SERVICES TO SUBMIT DOCUMENTS TO JDM REGISTRY, YOU EXPRESSLY ACKNOWLEDGE AND AGREE TO THE FOLLOWING:

• No JDM Registry Liability: JDM Registry Philippines, its owners, officers, employees, and affiliates shall not be held liable for any data breaches, unauthorized access, loss, corruption, or misuse of documents stored on third-party services
• Waiver of Damages: You waive any and all claims for damages, whether direct, indirect, incidental, consequential, or punitive, arising from the failure of any third-party document service to maintain adequate privacy, security, HIPAA compliance, or PII protection standards
• Indemnification: You agree to indemnify and hold harmless JDM Registry Philippines from any claims, lawsuits, regulatory actions, or penalties arising from your use of non-compliant third-party services for healthcare documents, identity documents, or any other sensitive personal information
• Your Due Diligence: It is your responsibility to read and understand the terms of service and privacy policy of any third-party document service before uploading sensitive documents

While JDM Registry does not endorse any specific service, we recommend considering the following when selecting a document sharing service:

• Use services that offer end-to-end encryption
• Enable two-factor authentication on your cloud storage account
• Set document permissions to "View Only" when sharing
• For healthcare documents, consider services that explicitly advertise HIPAA compliance (e.g., certain tiers of Google Workspace, Microsoft 365, or specialized healthcare platforms)
• Regularly review and revoke document access when no longer needed

For purposes of this Agreement:

• "Biometric Data" refers to the facial image photograph captured during the liveness verification process, including any derived facial geometry data used solely for real-time liveness detection (blink detection, head movement)
• "Liveness Verification" refers to the process of confirming that a real, live person (not a photograph, video, or deepfake) is present during verification
• "Data Subject" refers to you, the individual whose biometric data is being processed
• "Processing" includes the collection, recording, storage, retrieval, use, and erasure of biometric data as defined under the Data Privacy Act of 2012

YOUR CONSENT IS ENTIRELY VOLUNTARY. You are under no obligation, compulsion, inducement, or undue influence to provide your biometric data. No monetary compensation, rewards, or incentives are offered in exchange for your biometric data.

By proceeding with biometric verification, you affirm and warrant that:

• Free and Voluntary Consent: You are providing your biometric data of your own free will, without any form of coercion, undue influence, fraud, or misrepresentation from JDM Registry Philippines or any third party
• No Monetary Inducement: You have NOT been offered and are NOT receiving any monetary payment, cryptocurrency, tokens, gift cards, vouchers, or other financial incentives in exchange for submitting your biometric data
• Informed Decision: You have been fully informed of the purpose, scope, extent, and duration of data processing BEFORE providing consent, and you have had adequate opportunity to review this notice
• Legal Capacity: You are at least eighteen (18) years of age and have full legal capacity to provide consent under Philippine law
• Alternative Available: You understand that you may choose NOT to provide biometric verification, though this may limit your ability to use certain platform features that require identity verification

Your biometric data is collected and processed SOLELY for the following specific, declared, and legitimate purposes:

• Identity Verification: To verify that you are a real person and that your identity matches your submitted identification documents, thereby preventing fraud, impersonation, and misrepresentation on the platform
• Platform Trust and Safety: To maintain the integrity of the mechanics marketplace by ensuring that registered service providers are verified individuals
• Liveness Detection: To confirm in real-time that a live person (not a static photograph, pre-recorded video, or AI-generated deepfake) is present during the verification process

JDM Registry explicitly DOES NOT use your biometric data for:

• Facial recognition or identification across other platforms or databases
• Sale, transfer, or disclosure to third parties for any commercial purpose
• Creation of biometric templates for mass surveillance
• Training of artificial intelligence or machine learning models
• Any purpose beyond identity verification for this platform

JDM Registry implements the following safeguards for your biometric data:

• Secure Storage: Your facial image is stored using industry-standard encryption and access controls on secure servers
• Limited Access: Only authorized personnel (identity verification administrators) may access your biometric photo for the sole purpose of matching it against your submitted ID documents
• No Permanent Biometric Templates: Liveness detection data (facial geometry for blink/movement detection) is processed in real-time and is NOT stored permanently. Only the final captured photograph is retained.
• Retention Period: Your biometric photograph shall be retained only for as long as necessary to fulfill the stated purposes or as required by applicable law

As a Data Subject under the Data Privacy Act of 2012 (RA 10173), you have the following rights which JDM Registry fully respects and honors:

• Right to Be Informed (Sec. 16(a)): You have been informed, through this notice, of the nature, purpose, and extent of biometric data processing, including the risks involved and the safeguards in place
• Right to Access (Sec. 16(c)): You may request access to your biometric data, including information on how it was processed, to whom it has been disclosed, and the identity of the personal information controller
• Right to Object (Sec. 16(b)): You may object to the processing of your biometric data. If you object, we will cease processing unless there are compelling legitimate grounds for processing that override your interests
• Right to Erasure or Blocking (Sec. 16(d)): You may request the suspension, withdrawal, blocking, removal, or destruction of your biometric data from our systems, subject to verification of your identity
• Right to Rectification (Sec. 16(e)): You may dispute inaccurate information and have it corrected immediately
• Right to Data Portability (Sec. 16(f)): You may obtain a copy of your biometric data in a commonly used electronic format
• Right to Damages (Sec. 16(g)): You may claim compensation for damages sustained due to inaccurate, incomplete, outdated, false, unlawfully obtained, or unauthorized use of your personal data
• Right to File a Complaint (Sec. 16(h)): You have the right to lodge a complaint with the National Privacy Commission if you believe your data privacy rights have been violated

JDM REGISTRY FULLY SUPPORTS AND HONORS YOUR RIGHT TO DATA DELETION. You may request complete erasure of your biometric data at any time.

To exercise your right to deletion:

1. Submit a written request to privacy@jdmregistry.ph with the subject line: "BIOMETRIC DATA DELETION REQUEST"
2. Include your registered email address, full name, and a statement requesting deletion of your biometric (facial image) data
3. For security purposes, we may require identity verification before processing your request
4. Your request shall be processed within fifteen (15) days from receipt, or such shorter period as may be required by the National Privacy Commission
5. Upon deletion, you will receive written confirmation that your biometric data has been permanently erased from our systems, including any backups

Note: Deletion of your biometric data may result in the revocation of your verified status on the platform and may affect your ability to offer services on the mechanics marketplace.

You may withdraw your consent to biometric data processing at any time without affecting the lawfulness of processing based on consent before its withdrawal. To withdraw consent:

• Email privacy@jdmregistry.ph with the subject: "WITHDRAWAL OF BIOMETRIC CONSENT"
• Your request will be processed within ten (10) business days
• Upon withdrawal, your biometric data will be deleted and your verified status may be revoked
• You will not suffer any penalty, discrimination, or adverse consequences for withdrawing consent

BY VOLUNTARILY PROVIDING YOUR BIOMETRIC DATA, YOU ACKNOWLEDGE AND AGREE TO THE FOLLOWING:

• No Guarantee of Absolute Security: While JDM Registry implements industry-standard security measures, no system is completely immune to security breaches. JDM Registry shall not be held liable for damages resulting from sophisticated cyber attacks, hacking, or security breaches beyond our reasonable control, provided we have exercised due diligence in protecting your data
• Your Responsibility: You acknowledge that you have carefully read and understood this notice and are providing your biometric data with full knowledge of the risks and benefits
• Indemnification: You agree to indemnify and hold harmless JDM Registry Philippines, its officers, directors, employees, and affiliates from any claims, damages, or expenses arising from (a) your breach of this Agreement, (b) your provision of false or fraudulent biometric data, or (c) any third-party claim related to your use of the platform
• Compliance with Law: JDM Registry commits to comply with the Data Privacy Act of 2012, its Implementing Rules and Regulations, and all applicable National Privacy Commission circulars and advisories

JDM Registry acknowledges and commits to full compliance with the directives and guidance of the National Privacy Commission (NPC). In particular:

• We adhere to the General Data Privacy Principles of transparency, legitimate purpose, and proportionality as set forth in Section 11 of the Data Privacy Act
• We do NOT offer monetary or other financial incentives for biometric data collection, consistent with the NPC's guidance on valid consent (ref: CDO against Tools for Humanity, October 2025)
• We collect only the minimum biometric data necessary for the stated purpose (one facial photograph for identity verification)
• We respect and implement all eight (8) rights of data subjects under Section 16 of the DPA
• We maintain a Data Protection Officer (DPO) who can be contacted at dpo@jdmregistry.ph

When automated payment gateways are unavailable, JDM Registry may offer manual escrow payment options. Under this process:

• Buyers transfer funds directly to a designated platform account via QR code or bank transfer
• Buyers must verify their payment by submitting proof (screenshot/photo) along with transaction details
• Email verification via one-time password (OTP) is required to confirm identity
• Platform administrators manually review and verify payment submissions
• Funds are held until the transaction is completed or disputed

By using manual escrow, you acknowledge and accept the following:

• Verification Delays: Manual review may take longer than automated processes, typically 1-3 business days
• Human Error: Manual processes are subject to potential human error in verification
• Limited Recourse: Dispute resolution may be more complex than with automated payment systems
• No Chargeback Protection: Bank transfers and e-wallet payments generally cannot be reversed
• Data Logging: We log metadata including IP addresses, device information, and timestamps for fraud prevention and compliance purposes

Before using manual escrow, you must explicitly accept these terms through our consent modal. By accepting, you confirm that you:

• Understand the manual verification process and its limitations
• Accept responsibility for providing accurate payment information
• Consent to the collection and logging of transaction metadata
• Agree to cooperate with any verification requests from our team
• Understand that fraudulent submissions may result in account termination and legal action

IMPORTANT: JDM Registry does not employ mechanics and is not responsible for the quality, safety, or outcome of any services provided through the marketplace.

Mechanics listed on our platform are independent service providers. We do not:

• Guarantee the quality, safety, or legality of any mechanic services
• Verify the accuracy of mechanic qualifications beyond document review
• Supervise, direct, or control how mechanics perform their services
• Assume liability for any damage, injury, or loss resulting from mechanic services
• Provide warranties for work performed by mechanics

While we review mechanic applications and credentials, our verification process:

• Is based on documents and information provided by the mechanic
• Does not include background checks, skill assessments, or hands-on testing
• Does not guarantee the authenticity of submitted credentials
• Does not constitute endorsement, certification, or recommendation

Customers are strongly advised to:

• Review mechanic profiles, ratings, and reviews before engaging services
• Independently verify credentials and qualifications if concerned
• Communicate clearly about service expectations and pricing before work begins
• Inspect work thoroughly before confirming completion

Mechanics using our marketplace agree to:

• Provide accurate and truthful information about qualifications and experience
• Maintain valid credentials and licenses as required by law
• Perform services professionally and to industry standards
• Honor quoted prices unless additional work is explicitly agreed upon
• Respond promptly to customer inquiries and service requests
• Carry appropriate insurance for their services (where applicable)
• Comply with all applicable laws, regulations, and safety standards

Service orders are agreements between customers and mechanics. Payment terms include:

• Quoted prices are starting estimates; final pricing may vary based on actual work required
• Payments may be held in escrow until service completion is confirmed
• Customers must confirm service completion within 48 hours of mechanic notification, or payment may be auto-released
• Disputes must be raised before confirming completion
• Platform fees apply as specified in our Payment Terms

Our rating system is designed to help users make informed decisions:

• Only customers who completed a service order may leave ratings
• Feedback should be honest, fair, and based on actual experience
• We reserve the right to remove fraudulent, abusive, or irrelevant reviews
• Mechanics may respond to reviews but cannot have them removed unless they violate policies

THE JDM REGISTRY PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR SECURITY.

We do not warrant that:

• The platform will be uninterrupted, secure, or error-free
• Defects will be corrected
• The platform or servers are free of viruses or harmful components
• Results obtained from using the platform will be accurate or reliable

JDM Registry is a platform that connects buyers and sellers. We are not a party to any transaction between users. We do not:

• Guarantee the quality, safety, or legality of listed vehicles
• Verify the accuracy of user-provided information
• Guarantee that transactions will be completed
• Provide warranties or guarantees for vehicles listed on the platform
• Assume responsibility for user conduct or compliance with laws

TO THE MAXIMUM EXTENT PERMITTED BY LAW, JDM REGISTRY, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your use or inability to use the platform
• Any unauthorized access to or use of our servers or personal information
• Any interruption or cessation of transmission to or from the platform
• Any bugs, viruses, or harmful code transmitted through the platform
• Any errors or omissions in content or listings
• User content or conduct of any third party on the platform
• Any transactions between users

Our total liability to you for all claims arising from your use of the platform shall not exceed the greater of (a) the amount you paid us in the twelve months prior to the claim, or (b) ₱5,000.
